What the power of attorney actually is
A power of attorney, poder in Spanish, is a notarised document authorising your lawyer to act for you in defined matters: apply for your NIE, open a bank account, sign the private purchase contract, attend completion at the notary, pay the taxes, register the deeds, set up the utility direct debits. Signed in Spain, it’s remarkably light-touch: a short appointment at a notary, a modest fee of well under a hundred euros, and it’s done, ideally slotted into the same trip as your viewings.
Signed from abroad it’s possible but clunkier: you need a notary in your own country with the right powers, a bilingual deed and an apostille, which adds time and cost. Which is why the single best piece of scheduling advice in a Spanish purchase is this: if there’s any chance you’ll buy, sign the power of attorney before you fly home. It costs little, commits you to nothing, and it converts your one trip into everything the process will ever need from you in person.
What it unlocks, step by step
With the power of attorney in place, the sequence we mapped in our guide to the buying process runs without you. Your lawyer applies for and collects your NIE. The bank account gets opened for the utilities and taxes that ownership brings. When due diligence comes back clean, the contract is signed on your behalf. On completion day your lawyer sits at the notary’s table, pays the balance, takes the keys and, in the weeks after, walks the deeds to the land registry and switches every recurring bill to direct debit. You experience the purchase as a series of updates, and then as a set of keys waiting for you.
The hesitation, answered honestly
Some buyers pause at the idea of granting broad powers to a firm they met days earlier, and the hesitation deserves a straight answer rather than a brush-off. Three things to know. A power of attorney can be scoped: it can be drafted narrowly, covering only the acts this purchase requires, rather than as a general power over your affairs. It can be revoked: you can cancel it at any time through any notary. And the person exercising it is not a stranger with your chequebook but a regulated professional whose licence and liability stand behind every act done in your name. Granting a scoped power to your own independently retained lawyer is not an act of blind trust. It’s how the entire market operates, thousands of times a year.
It’s also worth naming what the alternative costs. Without a power of attorney, every signature is a flight. The NIE becomes a consular queue or a second trip, the completion date has to bend around your calendar rather than the deal’s, and a delay on either side can strand you rebooking travel to sign a single page. The absent-buyer machinery exists because the old way was worse for everyone.
The practical playbook
So the one-trip purchase looks like this. Before you fly: structure decision made, paperwork pack ready. During the trip: viewings, an offer, the reservation, and one notary hour for the power of attorney. After you’re home: due diligence, contract, completion and registration, all handled, all reported back to you. It’s the pattern our international buyers follow whether they’re purchasing an apartment in Hallo, a townhouse in La Reserva or something from the strandligging selectie, and it’s why buying from abroad, done properly, feels less like a leap of faith than most domestic purchases do.
The Spanish system asks you for one good trip. Spend it looking at property, and leave one signature behind when you go.
