This policy explains how Santina Homes collects, uses, and protects your personal data, in accordance with the EU General Data Protection Regulation (GDPR), Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD), and Law 34/2002 on Information Society Services (LSSI-CE).

2. Personal data we collect

We collect only the data needed to provide our real estate services and operate this website:

  • Contact details you submit through forms: name, email, phone, message, and property preferences (budget, area, timing).
  • Zone Finder quiz responses: lifestyle preferences, linked to your contact details only if you submit the final form.
  • Newsletter subscriptions: email address and consent preferences.
  • Technical data: IP address, browser, device, operating system, referring URL, and pages visited.
  • Cookies and analytics identifiers: see sections 7 and 8.
  • Data from Inmobalia: listings and enquiry information passed to us through our CRM and property database provider.

We do not knowingly collect data from minors. If a minor has submitted personal data, please contact us and we will delete it.

3. How we use your data

We process your data for the purposes below, each under a specific legal basis defined by the GDPR:

4. Who we share your data with

We only share your data with trusted parties, each bound by confidentiality or a data processing agreement:

  • Inmobalia, CRM and property database provider, acting as our data processor (EU-based).
  • Email and marketing tools, for transactional and newsletter delivery.
  • Analytics and search providers, Google Analytics 4, Google Search Console, and AI search assistants (OpenAI, Anthropic, Perplexity, Google SGE).
  • Hosting and infrastructure providers, EU-based.
  • Professional advisors, lawyers, accountants, and notaries involved in a transaction.
  • Public authorities, only when legally required.

We do not sell your personal data to third parties.

5. International data transfers

Some providers (notably Google and AI search assistants) may process data outside the European Economic Area. In those cases, transfers are covered by one of the following safeguards under Chapter V of the GDPR:

  • The EU-US Data Privacy Framework.
  • Standard Contractual Clauses approved by the European Commission.
  • Other equivalent adequate safeguards.

6. How long we keep your data

We retain personal data only for as long as necessary to fulfil the purpose it was collected for, or as required by law:

  • Active clients and leads: duration of the commercial relationship, plus up to 6 years (accounting) or 10 years (anti-money-laundering, Law 10/2010).
  • Unsuccessful leads: up to 24 months, then anonymised or deleted.
  • Newsletter subscribers: until you unsubscribe.
  • Website analytics: up to 14 months (Google Analytics 4 default).

7. Your rights

Under the GDPR and LOPDGDD you have the following rights over your personal data:

  • Access, obtain a copy of the data we hold about you.
  • Rectification, correct inaccurate or incomplete data.
  • Erasure, request deletion when there is no longer a legal basis for keeping it.
  • Restriction, limit processing in specific circumstances.
  • Objection, oppose processing based on legitimate interest or direct marketing.
  • Portability, receive your data in a structured, machine-readable format.
  • Withdraw consent, at any time, without affecting prior lawful processing.
  • Lodge a complaint, with the Spanish Data Protection Agency (AEPD, www.aepd.es).

8. Cookies

We use cookies and similar technologies grouped into four categories:

  • Strictly necessary, required for the site to work (session, security). No consent required.
  • Analytics, measure how visitors use the site (Google Analytics 4). Consent required.
  • Preferences, remember language and quiz progress. Consent required.
  • Marketing, not currently used; explicit consent would be required if introduced.

9. AI search and indexing

Santina Homes may appear in results generated by AI search assistants such as ChatGPT, Claude, Perplexity, or Google SGE. Public website content may be indexed by these services. We do not share personal data submitted through forms with AI providers.

10. Security

We apply appropriate technical and organisational measures to protect your data, including HTTPS encryption, access controls, secure backups, and vendor due diligence.

11. Changes to this policy

We may update this policy to reflect changes in our practices or legal requirements. The date at the top always reflects the latest version. We will notify subscribers by email or a site banner for material changes.
