A Spanish mortgage default doesn’t go straight to auction. The bank first files a demanda ejecutiva at the local court, then a requerimiento de pago gives 10 days to pay voluntarily. From there the owner has another 10 days to formally oppose, on limited legal grounds. If none of that stops it, the property goes to the Portal de Subastas del BOE for a minimum 20-day bidding window. Start to finish, an uncontested case usually runs 10 to 18 months, longer with an opposition or a parallel claim. That timeline is exactly what gives a private sale or a negotiated exit room to happen before the gavel does.
Dáción en pago itself is written into Spanish law, not just bank goodwill. Under the Código de Buenas Prácticas (Real Decreto-ley 6/2012), an owner whose household income doesn’t exceed roughly three times the IPREM, or whose mortgage payment eats more than half of household income, qualifies for the “umbral de exclusión.” Inside that threshold, dáción en pago can be requested even once an auction date is already set, and notarial and registry fees for cancelling the mortgage are cut in half. Outside it, or once there’s negative equity, a controlled private sale is usually the better route. Either way, the earlier we’re in, the more of these options are still open.

Can I stop a mortgage auction once it’s already been scheduled?
Often, yes. A controlled private sale can still go ahead right up to the auction date in many cases, and dáción en pago itself can be requested even with a date already set, if the owner qualifies under the umbral de exclusión. Earlier is always better, but a scheduled date isn’t automatically the end of the road.
What is dáción en pago and do I qualify?
It’s handing the property back to the bank in exchange for the mortgage debt being cancelled. Under Spanish law, it’s available if household income doesn’t exceed roughly three times the IPREM, or the mortgage payment eats over half of household income, and there’s no negative equity.
